Defense Verdicts

In a case where the Plaintiff rejected a seven-figure offer, firm attorneys secured a defense verdict in the United States District Court for the District of New Jersey.  Plaintiff claimed he required five spinal surgeries, including a failed back fusion, after slipping and falling near a display.  The Plaintiff proffered medical expenses totaling over $1.27 Million in past medical bills and served a life care plan estimating an additional seven figures of future medical bills. After cross-examination, the Court precluded the Plaintiff’s liability expert. At trial, firm attorneys confronted Plaintiff’s treating surgeon with evidence that he had financial relationships with the radiological center, physical therapy facility, and surgical center, and that his bills were grossly inflated. During the surgeon’s testimony, he admitted that he had no reasonable basis to support his charges, which resulted in most of the bills being withdrawn from the jury’s consideration. The jury found no negligence.

Defense Verdicts

Firm attorneys secured a defense verdict in the United States District Court for the Eastern District of Pennsylvania where Plaintiff alleged that an electric grill fell from a top shelf onto her head causing a traumatic brain injury and cervical injuries. The Plaintiff also claimed significant lost earnings due to her alleged inability to continue working as a “high roller” blackjack dealer.  After motions in limine, the firm successfully excluded Plaintiff’s liability expert; and the Plaintiff withdrew a biomechanical expert. Before the trial, the Plaintiff rejected a significant offer and made demands exceeding seven figures. The jury found no liability.

Defense Verdicts

Firm attorneys secured a defense verdict in Gloucester County, New Jersey on behalf of a major transportation company. The Plaintiff alleged that he was injured after falling while unloading the client’s trailer. He testified that the truck driver pulled away from the loading dock while he was still partially standing in the trailer. The Plaintiff had previously received a favorable arbitration award, which was appealed to a trial de novo. The trial involved questions of agency and control over the actions of the truck driver; but through the presentation of multiple witnesses and evidence, we successfully argued that the owner of the trailer bore no responsibility for the accident. Specifically, we presented evidence that the client’s drivers were not using the loading dock at the time of the alleged accident. After a short deliberation, the jury found no agency relationship between the client and the truck driver. Based upon the jury’s factual finding, the court entered judgment in the defendant’s favor.

Dispositive Motions

Firm attorneys obtained summary judgment in a corporate client’s favor in the Middle District of Pennsylvania. The plaintiff alleged a trip and fall on an unattended object placed in a grocery store aisle. Based on testimony developed during the plaintiff’s deposition, we argued that, despite the plaintiff’s claim that she did not subjectively appreciate the condition, a reasonable person in her position would have seen and avoided it. The Judge found that the condition was open and obvious, absolving our client of liability.

Dispositive Motions

Firm attorneys obtained summary judgment in favor of a major retailer in the Eastern District of Pennsylvania. The plaintiff alleged a slip and fall on a condition that he claimed was present over a period of time and that the retailer defendant had failed to remedy the condition. The plaintiff lacked clear and contemporaneous proofs but attempted to create a dispute of fact based on purported evidence spoliation. We successfully argued that the plaintiff failed to meet his burden to establish spoliation and had failed to adduce sufficient evidence of notice. Summary judgment was granted in favor of our retail client, and it was upheld on a subsequent motion for reconsideration.
